Drug trafficking, narcotics trafficking or simple drug use in Turkey

Turkey has no special criminal code for narcotics and instead, Turkey regulates these crimes in the Turkish Criminal Code (TCC/TCK).

Article 188 of the Turkish Criminal Code orders the manufacture and trade of narcotics and stimulants. Accordingly, anyone who produces, imports or exports narcotics or stimulants without approval or in violation of approval is punished with 20 years up to 30 years in prison and a fine of 2,000 to 20,000 daily rates. Article 188 Paragraph 3 of the Turkish Criminal Code provides for a punishment if someone sells, offers for sale, passes on, sends, transports, stores, buys, accepts or owns these drugs within Turkey without authorization or in violation of authorization. In this case, the penalty provided is lower compared to the paragraph above, but still too high. Namely, it is a sentence of not less than ten years in prison and a fine of 1,000 to 20,000 daily rates. The punishment is made even more severe if this drug consists of cocaine, morphine, heroin, etc. In addition, a number of reasons for increasing the sentence and possibilities for reducing the sentence are laid down in the same article.

Compared to trading, the consumption of narcotic drugs is provided with lighter penalties. Here the punishment starts from 2 to 5 years in prison.
