Wer eine Reise, ob privat oder beruflich, in die USA plant, nutzt regelmäßig auch ein Auto, meist einen Mietwagen. Was passiert, wenn ein Ausländer in den Vereinigten Staaten mit einem Leihwagen einen Autounfall verursacht?

Wenn der Fall der Fälle eintritt und es im Ausland (hier insbesondere in den USA) zu einem Verkehrsunfall kommt, stellt sich unmittelbar die Frage, ob und wie ein Nicht-Amerikaner gerichtlich hiergegen vorgehen kann.

Zunächst einmal ist es vorab wichtig, um ein erfolgversprechendes Verfahren führen zu können und Versicherungsansprüche rückwirkend geltend zu machen, sämtliche Details des Unfallgeschehens und alle Folgemaßnahmen so detailliert wie möglich festzuhalten.

Der Betroffene sollte weiterhin darauf achten, auch eine Kopie des Polizeiberichtes (sog. protocol oder police record) aushändigen zu lassen und auch Dokumentationen zu etwaigen Verletzungen, ärztlichen Maßnahmen und Arztrechnungen sorgfältig aufzubewahren. Darüber hinaus sollten die eigene Haftpflichtversicherung, die deutsche Krankenversicherung sowie der Halter des Mietwagens und dessen Versicherung zeitnah über den Unfallschaden informiert werden.

Prozesse in den USA sind kostspielig und grundsätzlich von jedem selbst zu tragen. Es gibt hier gerade nicht das Prinzip, dass der obsiegende Teil eines Gerichtsverfahrens seine Kosten erstattet erhält. Deshalb, um Anwaltskosten und Gerichtskosten bezahlen zu können, ist es dringend anzuraten, unbedingt vor Reiseantritt eine Rechtsschutzversicherung mit internationalem Geltungsbereich abzuschließen. Diese deckt auch schon kleinere Unfallschäden im Ausland ab und greift auch bei eventuell anfallenden Kosten für die Vertretung durch einen Anwalt und Gerichtsverhandlungen in den USA. Hier sollte der Betroffene im besten Fall auch darauf achten, dass der Versicherungsvertrag mit Auslandsschutz keine sog. Deckelungsklausel enthält, wonach die Versicherung nur bis zu einer bestimmten Summe die Kosten übernimmt.

Auch kann es erforderlich werden, dass bei andauernden Verhandlungen der Betroffene ggf. nochmals in die USA reisen muss, etwa als Geschädigter oder Zeuge. Dies ist oft im Rechtsschutz inbegriffen. Außerdem besteht auch bei größeren Fällen zudem die Möglichkeit, im Rahmen eines Erfolgshonorars vertreten zu werden.

Hinsichtlich des Unfalls am sog. Tatort des Geschehens sollte der Betroffene unbedingt beachten, dass man grundsätzlich dazu verpflichtet ist, Aussagen zum Unfallhergang und zur eigenen Person zu machen. Vorsicht ist aber geboten, wenn die Polizei bei der Befragung ausdrücklich auf das Schweigerecht verweist. In diesem Fall gilt ein Beteiligter strafrechtlich gesehen als potenzieller Beschuldigter, dessen Aussagen dann später gegen ihn verwendet werden können. Sie haben daher immer das gesetzliche Recht zu schweigen, was Sie auch dringend tun sollten. Car accident in the U.S. – what foreign travelers should do now

This is often included in legal protection. In addition, there is also the possibility to be represented in the context of a success fee even in bigger cases.

With regard to the accident at the so-called crime scene of the event, the person concerned should absolutely note that they are in principle obliged to make statements about the accident and about themselves. However, caution is advised if the police explicitly refer to the right to silence during the survey. In this case, a party is criminally considered a potential defendant whose statements can then later be used against him. You always have therefore the legal right to be and remain silent, which you should urgently do and take seriously.
